Big Case Projection List

Overview

The purpose of the Enforcement section is to record and track actions taken to address noncompliance with environmental laws by a regulated entity. The Enforcement process begins once a Violation has been detected.

Big Case Projection is a management process to identify and track OECA’s projected “big cases” to better understand the likely outcomes for the annual accomplishments before the end of the year. “Big cases” are defined based on the following criteria:

· Civil penalty amount of at least $1 million

· Injunctive relief and SEP combined, estimated amount of at least $5 million; or

· Cost recovery value of at least $5 million; or

· Pounds of pollutants reduced, estimated amount of at least 1 million pounds; or

· Clean up commitment value of at least $5 million; or

· Volume of contaminated soil or water/aquifer clean-up commitment of at least 1 million cubic yards

These are best available estimates by the Region that a case will conclude at an amount that will equal or exceed at least one of these criteria. Big Case Projection is only available for federal Administrative Formal and Judicial actions and can only be viewed by users with Sensitive privileges.

Screen Fields

Screen Section	Field Name	Field Description
Header	Enforcement Action Identifier	This is the alphanumeric identifier used to identify an Enforcement Action pertaining to a specific regulated entity or Facility.
Header	Enforcement Action Name	This is the formal name of the Enforcement Action as shown on the caption of the legal instrument.
Header	Issued By	This indicates whether the Enforcement Action is a federal (i.e., EPA) or state-issued action.
Header	Forum	This is the legal forum in which the Enforcement Action is brought.
Big Case Projection	Superfund ID Number	The Superfund ID Number in CERCLIS.
Big Case Projection	BCP Civil Penalty Value	The estimated dollar amount of the civil penalty expected to be obtained from a formal EPA Enforcement Action. This value also may be stipulated penalties expected to be obtained upon demand, or stipulated penalties or an additional civil penalty expected to be imposed in an action to enforce a consent decree or agreement or other court order.
Big Case Projection	BCP Complying Action + SEP Value (including Clean-up Commitment Value)	The estimated costs expected to be incurred by the defendant/respondent, acting in response to an EPA formal Enforcement Action, to attain compliance with the law and restore the environment plus the expected costs associated with implementing any SEP.
Big Case Projection	BCP Cost Recovery Value	The estimated amount of cost recovery expected to be obtained from the responsible party or parties and due the Superfund in accordance with a formal EPA Enforcement Action.
Big Case Projection	BCP Pollutant Reduction (lbs.)	The estimated pollution reduction commitment expected to be obtained from a formal EPA Enforcement Action.
Big Case Projection	BCP Hazardous Waste Treated, Etc. (lbs.)	The estimated commitment to treat, minimize, or dispose of hazardous waste expected to be obtained from a formal EPA Enforcement Action.
Big Case Projection	BCP Contaminated Soil to be Addressed (cu. yds.)	The estimated volume of contaminated soil clean-up commitment expected to be obtained from a formal EPA Enforcement Action.
Big Case Projection	BCP Contaminated Aquifer/Water to be Addressed (cu. yds.)	The estimated volume of contaminated water/aquifer clean-up commitment expected to be obtained from a formal EPA Enforcement Action.
Big Case Conclusion Date	BCP Fiscal Year (FY)	The fiscal year in which it is expected that the Enforcement Action will conclude (i.e., when the civil judicial consent decree or order will be signed by the judge and entered by the court, when the final administrative penalty order is issued, or when the administrative compliance order (or ACO or UAO) is issued).
Big Case Conclusion Date	BCP Comments	The free-form textual comments entered to further describe the corresponding Big Case Projection.

Delete	This allows the user to delete the Big Case Projection.

Facilities	This displays the List of Facility Interests Related to the Enforcement Action screen. This screen contains a list of Facility Interests that are associated with the current Enforcement Action and allows the user to add, edit, view, and delete a Facility Interest.
NPDES Permits	This displays the List of Permits Related to the Enforcement Action screen. This screen contains a list of NPDES Permits that are associated with the current Enforcement Action and allows the user to add, edit, view, and delete a NPDES Permit.
Incidents	This is for Federal users only. This displays the List of Incidents Related to the Enforcement Action screen. This screen contains a list of Incidents that are associated with the current Enforcement Action and allows the user to add, edit, view, and delete an Incident.
Compliance Monitoring	This displays the List of Compliance Monitoring Activities Related to the Enforcement Action screen. This screen contains a list of Compliance Monitoring Activities that are associated with the current Enforcement Action and allows users to link and unlink a Compliance Monitoring Activity to the current Enforcement Action. Also, users can add, edit, view, and delete a Compliance Monitoring Activity.
Voluntary Disclosures	This is for Federal users only. This displays the List of Voluntary Disclosures Related to the Enforcement Action screen. This screen contains a list of Voluntary Disclosures that are associated with the current Enforcement Action and allows the user to add, edit, view, and delete a Voluntary Disclosure.
Case Files	This is for Federal users only. This displays the List of Case Files Related to the Enforcement Action screen. This screen contains a list of Case Files that are associated with the current Enforcement Action and allows the user to add, edit, view, and delete a Case File.
ADRs	This is for Federal users only. This displays the List of ADRs Related to the Enforcement Action screen. This screen contains a list of ADRs that are associated with the current Enforcement Action and allows the user to add, edit, view, and delete an ADR.
NPDES Violations	This displays the List of NPDES Violations Related to the Enforcement Action screen. This screen contains a list of NPDES Violations that are associated with the current Enforcement Action and allows users to link and unlink a NPDES Violation to the current Enforcement Action. Also, users can add a Single Event Violation and edit, view, and delete all Violations.
Compliance Assistance	This is for Federal users only. This displays the List of Compliance Assistance Activities Related to the Enforcement Action screen. This screen contains a list of Compliance Assistance Activities that are associated with the current Enforcement Action and allows the user to add, edit, view, and delete a Compliance Assistance Activity.
